General Conditions

IMPORTANT. PLEASE UNDERSTAND THAT YOU ARE AGREEING TO ALL OF THESE TERMS WHEN YOU BOOK ANY KIND OF TRAVEL WITH US OR WHEN YOU BOOK OR GO ON TOURS AND EXCURSIONS.

Tour and excursion terms. AllAboardTravel.com utilizes third party tour and excursion operators ("Operators") for our tours and shore excursions ("Excursions.") All Excursions are subject to cancellations or changes without prior notice. Operators reserve the right to deny participation to any guest based upon criteria they may establish. AllAboardTravel.com does not own, control or operate any kind of transportation company or service, or any Operator. These Operators are owned and operated independently of AllAboardTravel.com and there are no joint ventures or other co-sponsored or jointly operated activities between AllAboardTravel.com and any Operator.

AllAboardTravel.com does not assume responsibility or liability for any damages, injuries or lost baggage that may occur for any reason during or as a result of any Excursion. AllAboardTravel.com is not responsible for any negligent act, omission or failure to act on the part of the Operator and AllAboardTravel.com is not liable for any alleged negligence in selecting the Operator or offering its products. There are no representations or promises made by AllAboardTravel.com that in any way take precedence over these General Conditions.

Guest assumes 100% of the risk of participating in the Excursion and agrees that it will not bring any type of action against AllAboardTravel.com for any injury or damage that occurs in connection with the planning, selection or operation of any Excursion. To the full extent permitted by law, and in consideration of being allowed to participate in the Excursion, guest releases AllAboardTravel.com and its agents, representatives, employees, directors and officers, and waives any rights it may have against said parties for damages or claims arising from or in any way connected with guest's participation in the Excursion.

General terms. These terms apply to all travel booked or offered by AllAboardTravel.com and to all causes of action guest may have against AllAboardTravel. These terms and guest's rights shall be governed and interpreted by the laws of, and any cause of action brought exclusively in the jurisdiction of, the country in which the cause of action arises; if in the United States, it shall exclusively be the federal and state courts in the Eastern District of Virginia. Guest hereby agrees to waive any right it may have to a jury trial and further agrees that to the extent any damages are recoverable against AllAboardTravel, those damages are limited in amount to the amount paid by the guest to AllAboardTravel.com for the cruise and the Excursions. These terms apply to guest, to anyone to whom guest assigns a booking and to any minors or others over whom guest has authority to contract. By bringing a minor on an Excursion, guest is representing that it has the authority to bind the minor and guest will defend and indemnify AllAboardTravel.com for any damages recoverable by the minor.

Excursions leave rain or shine unless otherwise notified by the Operator.

Important Note: The most recent version of the flyer takes precedence over any previous versions.

Deposit & Final Payment: An initial deposit must be made within 48 hours of reserving space unless other- wise specified by the supplier. All prices are plus applicable port fees and government taxes, hotel, air depar- ture and other service fees, surcharges or taxes and are subject to change at any time without notice until booked and deposit is received. Additional surcharges may apply even after payment of deposit, should they be implemented by the supplier. Final payment is due per your All Aboard Travel invoice. To take advantage of the check discount (when applicable) the maximum amount that can be charged to a credit card is the deposit. No additional payments or extra amounts are allowed by credit card to qualify for the check discount. All pricing quoted is per person, USD.

Cancellation Policy: Loss of deposit for any cancellation after a booking is made will apply per the supplier's current cancellation policy. All Aboard travel will assess a per person cancellation fee in addition to the suppli- er's cancellation penalties. This additional fee will be due at time of cancellation. From 120 until 90 days prior to departure there is a penalty of 25% of the cruise fare or full loss of deposit amount (whichever is greater). After final payment, cancellation penalties are as follows: 89-76 days prior is 50%; 75 - 61 days prior is 75%; within 60 days is full penalty. Percentages apply to total cost of trip including any air add-ons and are plus the All Aboard Travel cancellation fee. Note: For cruises lasting 29 days or longer, and cruises during the holidays, penalties for cancellation would begin 120 - 90 days from the cruise sail date at 25% of the cruise fare or full loss of deposit (whichever is greater). After final payment, cancellation penalties are as follows: 89-76 days prior is 50%; 75 - 61 days prior is 75%; within 60 days is full penalty. Percentages apply to total cost of trip including any air add-ons and are plus the All Aboard Travel cancellation fee.

Documents: You will receive documents approximately 10 days before your departure date, so long as final payment has been received. If you have two addresses, please clearly state to which address you would like your documents sent.

Travel Protection is Highly Encouraged: Optional Travel Protection is per person and the premium is based on the overall trip cost. All travelers are encouraged to purchase a plan at the time of initial deposit. To be eligible for the Pre-Existing Condition Waiver, a plan must be purchased within the time sensitive period detailed in the plan document. Coverage will not be purchased until payment is received. This plan is subject to limitations and exclusions, including a pre-existing condition exclusion. For costs and complete details of coverage, contact your travel consultant.

Transportation: Bus from select locations is offered for most departures from Miami or Ft. Lauderdale cruise ports. Custom pickup may be offered when your group reaches a minimum requirement of passengers at one approved location. The minimum requirement is set by the supplier. If your group does not reach the minimum requirement of passengers, transportation is still offered from the central pickup locations. No credit or refunds will be issued for transportation not used. Your booking office is not responsible for chang- es in pickup locations or times.

Luggage/Baggage Allowance: The flyer rates have been costed for ONE suit case and one carry-on per person for any motor coach travel only; additional surcharges will be applied for additional baggage. (This DOES NOT include any airline imposed baggage fees. Those fees are separate from the flyer rates and payable to the airline directly.) Due to limited motor coach capacity, we are unable to accept a second suitcase or any luggage exceeding these limits on your vacation. Please note that air carriers, cruise lines, and other forms of trans- portation may have restrictions and requirements including weight. Many air carriers request dimensions not exceeding 30"x18"x10" and weight not exceeding 50lbs (23kg). Please be sure to check your carrier dimensions prior to arriving at the airport, to avoid additional handling fees. All Aboard Travel is not respon- sible for any additional fees imposed by airlines or transportation services on baggage. Baggage handling is not included unless specified on your travel vouchers. Please also be prepared to carry your own suitcase on and off airplanes, cruise ships, buses, trains, through airports, cruise terminals, train stations and at bus pick up and drop off locations. You may use porters at your own expense at the airports, piers, hotels, and train stations if you require assistance.

Proof of Citizenship: A valid passport is your best form of proof of US citizenship. Most cruises leaving the United States will accept a raised seal birth certificate with a government issued photo identification, please check with your travel advisor for the most up-to-date requirements. A Visa may be required for some international destinations. If you are not a US citizen you must check with your consulate office to insure proper documents. Your booking office can provide you with the phone numbers. Your booking office will not be responsible for proper proof of citizenship, Visa, vaccinations or any fees associated with such documentation or inoculations. (Travelers to and from the Caribbean, Bermuda, Panama, Mexico and Canada will be required to have a passport or other government issued photo identification to enter or re-enter the United States. For Minors under Age 14 you must establish proof of citizenship AND proof of relationship. Previous U.S. passports are not acceptable as proof of relationship to the applying parent(s)/guardian(s). This is a change from prior travel requirements and will affect all United States citizens entering the United States from countries within the Western Hemisphere who do not currently possess valid passports. This new requirement will also affect certain foreign nationals who cur- rently are not required to present a passport to travel to the United States. Most Canadian citizens, citizens of the British Overseas Territory of Bermuda, and to a lesser degree, Mexican citizens will be affected by the implementa- tion of this requirement.) Dates of Implementation are as follows: January 8, 2007 – Requirement applied to all air and sea travel to or from Canada, Mexico, Central and South America, the Caribbean, and Bermuda. January 1, 2008 – Requirement extended to all land border crossings as well as air and sea travel.

Responsibility: The responsibility of your booking office is strictly limited. As an operator we sell the services of cruises, hotels, restaurants, airlines, attractions, etc. The operator is not responsible for any intentional or unintentional actions or omissions by suppliers. Your booking office reserves the right to substitute any services of similar or equal quality. Your booking office cannot be responsible for circumstances, causes, effects, weather, strikes, bankruptcy, etc., of suppliers. Your booking office cannot guarantee airlines, flight times, seat assignments, hotels, restaurants, shows, motorcoach vendors, or any other suppliers and changes may occur with regard to those suppliers and the services booked. Changes to the suppliers and/or the services booked have in no way any effect on your ability to cancel or waive the cancellation penalties that will be imposed as a result of your cancellation. Depending on home air gateway, a forced overnight in the originating city may be necessary at the traveler's expense. Entrance & departure taxes assessed by any city, state or country cannot be prepaid and will be each person's responsibility at the time of departure.

Special Needs: Guest with special needs including wheelchair should be self-sufficient or accompanied by a companion to provide any required assistance. Some ports of call and shore excursions may limit special needs passengers from leaving the vessel. Passengers must bring wheelchair for their own use and must notify your booking office before final payment.

Acceptance: Acceptance of cruise or tour participation means that the passenger agrees with all of the above terms and conditions and that each participant agrees that your booking office shall not be liable for any damage, loss or expenses occasioned by any suppliers. It is also agreed by and between passenger(s) and your booking office that all disputes and matters whatever arising under, in connection with or incidental to this agreement shall be litigated, if at all, in and before a court located in the city of Minneapolis, County of Hennepin, State of Minnesota, U.S.A. to exclusion of the courts of any other city, state or country.

Travel Protection

To help protect your trip and your investment, the purchase of travel protection is highly encouraged.
